GENERAL TERMS AND CONDITIONS OF ONLINE SALE VIA L'ORC FOR THE RENTAL OF THE 2 TOURIST CHALETS CASA GAUMAISE AND CASA COOL
ARTICLE 1: GENERAL PROVISIONS

The contract is a tourist rental contract. The rental period is an essential condition.
The tenant cannot establish their main residence in the rented building.
The property includes 2 accommodations with a maximum capacity of 6 people (including baby).
Accommodation 1: Tourist chalet "La Casa Gaumaise", Above Rabais 30, 6760 Ethe.
Accommodation 2: Tourist chalet "La Casa Cool", Above Rabais 29, 6760 Ethe.
The tenant must respect the maximum capacity. Any violation may result in the immediate termination of the contract.
The reservation is for a minimum of 2 nights and is valid for the chosen arrival date.
The tenant must show up on the specified day.
ARTICLE 2: TERMS OF CONCLUSION OF THE CONTRACT
The rental becomes effective upon payment of a 30% deposit on the price of the stay.

The remaining 70% must be paid no later than 30 days before arrival to the same bank account.
Bookings made within 30 days of arrival must be paid in full upon receipt of the voucher.
Unless otherwise stated, the price of the stay does not include the €200 security deposit .
ARTICLE 2 bis: THE GUARANTEE
Amount: €200 , payable 30 days before the stay by bank transfer to the landlord's account number or in cash upon arrival.
The landlord can refuse access if the deposit is not paid.
The refund will be made no later than 2 weeks after departure if no damage is found.
The deposit will be returned within 15 days of departure if there is no damage to the accommodation, outbuildings and surrounding area.
The security deposit is intended to cover any debts that the tenant may still owe to the landlord upon returning the premises. In the event of a dispute, the landlord may, at their own risk, retain the security deposit until liability is clearly established. If it turns out that the tenant does not owe the amounts claimed and that all or part of the deposit must be returned, the landlord will owe interest at the legal rate on the amount to be ultimately refunded.
ARTICLE 3: SOLIDARITY
In the case of multiple tenants, the person who made the reservation is responsible for the entire group.
ARTICLE 4: LATE PAYMENT
In the event of non-payment within the deadline, the landlord may terminate the lease within 2 days of the due date.
Any amount not paid within 7 days automatically accrues interest at the legal rate.
ARTICLE 5: CANCELLATIONS – EARLY DEPARTURE – NO-SHOW
a) Cancellation by the tenant
Must be notified by registered mail or email.
The voucher cancellation conditions apply.
In case of force majeure: postponement or voucher.
If no agreement is reached within 18 months: full refund.
b) Cancellation by the landlord
Same procedure and same conditions as above.
c) Premature departure
No refunds.
d) Failure to appear
After 24 hours:
the reservation becomes void
the payments remain due
the landlord can re-let the property
ARTICLE 6: RESPONSIBILITIES – INSURANCE
The tenant must have Family Civil Liability insurance.
ARTICLE 7: DOMESTIC ANIMALS
Pets are allowed with the owner's permission. They must be declared to the landlord. A supplement applies.
ARTICLE 8: USE AND OCCUPANCY OF PREMISES
The tenant agrees to behave respectfully towards the residents and the environment in general (wildlife, plants, various equipment, etc.). They will use the rented property in accordance with its intended purpose and in a prudent, respectful, and responsible manner.
The tenant must return the property in the condition in which it was received. The tenant is responsible for any loss or damage to the landlord.
Lively parties such as student revelry, stag/hen parties, dance parties… are not allowed.
Non-smoking and non-vaping accommodation.
ARTICLE 9: CLAIMS
Any complaint must be sent to the landlord by registered letter or email within 8 days of the end of the stay. Supporting documents must be attached.
In the absence of an agreement between the parties, only the courts of the judicial district where the accommodation is located have jurisdiction.
ARTICLE 10: PASSENGER CHECK
The landlord has the right to verify and register the identity of all occupants of the accommodation in accordance with the 2007 law. The tenant must present a valid identity document (identity card or passport). This should be verified with the CGT (General Confederation of Labour).
ARTICLE 11: ACCEPTANCE OF GENERAL TERMS AND CONDITIONS
The tenant is deemed to have accepted the general terms and conditions at the time of booking or payment.
The prices shown include taxes and fees.
The services are chosen by the client, who assumes responsibility for them.
The booking confirmation is sent by email.
In accordance with Article VI.53 of the Belgian Economic Code, there is no right of withdrawal for tourist accommodation services.
DATA PROTECTION
Data processed in accordance with the GDPR.
They are necessary for managing the reservation and can be transferred to partners (booking tool, payment providers, etc.).
With consent, they can be used for commercial communications.
Shelf life: 3 years after last contact.
The customer has the right to access, rectify, delete, and object to their data by contacting us via email at sofaye10@hotmail.com.
Any complaint can be addressed to the competent supervisory authority.
